The Working Group found that many U.S. and Chinese companies want to act responsibly in China, but they face several problems: government implementation of Chinese law is uneven; it is difficult for foreign investors in particular to identify what laws apply when national, provincial, and local laws are in conflict; compliance with Chinese social and environmental laws is often voluntary; and Chinese citizens and policymakers frequently do not know about their rights and responsibilities under Chinese law. In addition, Chinese law does not fully protect human rights, in particular worker rights,as defined byInternational Labor Organization (ILO) standards.
